Debra Young Maggart, R-Hendersonville, introduced a bill last month that would require youths 14 or older to be placed onto a public registry for violent sexual offenses such as rape or attempted rape. The bill, House Bill 2789, also states that when the offenders turned 18, they would continue to have a record as an adult and would be placed on the adult registry.
The major issue with this bill if it makes its way to the Governor’s desk for signature is the fact that there are no concessions for reformed offenders, especially offenders convicted of statutory rape charges. According to this bill any sex crime committed regardless of the age of the offender will carry over as an adult felony charge.
Anthony Baltimore of the Support for Teen offender Network says that if this bill passes it will actually lead to an increase in crime rather than a reduction. He went on to say that many convicted teen offenders are now functioning as productive members of society with no other reoccurring offenses.
“I am not opposed to this law because I want sex offenders to fall through the cracks, but at the same time we are advocating for a second chance for reformed offenders. We are simply asking that the courts to consider the age of the offender and give them a fair chance to have productive life.”
The reality is this; we are slowly becoming a very barbaric society if we issue life sentences for offenses that took place when the offender was still considered a minor. If House Bill 2789 were to become the norm across this country, then as a nation we are placing a penalty on sex crimes higher than any other crime committed including the act murder.
